STATE & ORS.

Mr. KR CHOUDHARY, for the appellant / petitioner Date of Order : 20.12.2004

HON'BLE SHRI N P GUPTA,J. HON'BLE SHRI KRISHAN KUMAR,J.

ORDER

-----

Heard learned counsel for the petitioner.

There is nothing in the writ petition to show that the petitioneris at all any public spirited person to claim any locus to institutethis public interest litigation. That apart, from the entire writpetition, all that transpires is that it is a matter of shifting of theroad from one place to another, which is a matter lying in theadministrative discretion of the government, through the authoritiesconcerned, in which, we are not inclined to interfere in our writjurisdiction. The writ petition is, therefore, dismissed summarily.
