ORDER31.12.2022
The petitioner in the instant petition filed under Article 226 of the constitution of India seeks a direction against the respondents for making payments of a pending liability amounting to Rs. 8.23 lakh w.e.f. January, 2018 to Janurary, 2021 on account of hiring the vehicle of the petitioner bearing Registration No. JK02AD-7809 as the respondents are alleged to have failed to address to the repeated demand of justice made by the petitioner in this regard.
According to learned counsel for the petitioner, the liability, the respondents owe to the petitioner is not disputed but is an admitted one yet the respondents are not liquidating the said liability without any lawful justification.
Learned counsel for the petitioner would pray for disposal of the petition at this stage with an innocuous direction to the respondents to consider the claim of the petitioner within some time frame and without any further delay.
At this stage, Mr. Ranjeet Singh Jamwal, learned AAG enters appearance and waives notice on behalf of the respondents and does not oppose in principle the disposal of the petition or else the prayer made by learned counsel for the petitioner, however, Mr. Jamwal would submit the claim of the petitioner would be considered on its own merits in accordance with applicable rules.
In the aforesaid back-drop, the instant petition is taken up for disposal at this stage and is disposed of with a direction to the respondents to accord consideration to the claim of the petitioner as alleged in the instant petition expeditiously and preferably within a period of eight weeks from the date a copy of this order is produced before the respondents by the petitioner alongwith the copy of the writ petition accompanied with annexures thereto.
