IN THE HIGH COURT OF UTTARANCHAL AT NAINITAL ORIGINAL JURISDICTION

Dated: Nainital the 5[th] day of December 2003 Criminal Misc. Bail Application No. 1127/2003 Order on the bail application of accused.

CRIMINAL SIDE

Gambhir Singh Rana S/o Inder Singh Rana R/o Nursery Road Srinagar Pauri Garhwal …..Applicant.

Versus

State of Uttaranchal …Opposite party.

Arising out of case crime No. 432/2003 U/Ss 406, 420, 506 I.P.C. P.S. Kotwali Pauri District Pauri Garhwal.

By the Court

Hon’ble Irshad Hussain, J.

Heard Sri Pankaj Purohit, learned counsel for the applicant and learned A.G.A. for the State.

Applicant-accused is not named in the F.I.R. There is allegation that the applicant-accused also fleeced money at the instance of those persons who have promised job to the complainant. The case is triable by the Magistrate. Having considered the facts of the case I find it a fit case for bail. The bail application is allowed.

The applicant-accused Gambhir Singh Rana shall be released in crime No. 432/2003 under sections 406, 420, 506 IPC P.S. Kotwali Pauri, District Pauri Garhwal on his executing a personal bond and two sureties each in the amount to the satisfaction of C.J.M., Pauri Garhwal.
