WPSB NO. 280 of 2001

Hon’ble P.C. Verma, J.Hon’ble M.C. Jain, J.

The petition has been filed by the petitioner seeking a direction in the nature of certiorari to quash the order dated 14.02.2001 which has been passed by the District Administrative Committee in total disregard of the orders passed by the Regional Committee under the provision of U.P. Primary of U.P. Primary Agriculture Co-operative societies Centralised Services Rules 1976. The petitioner was transferred from one Primary Agriculture credit co-operative society to another Primary Agriculture credit Co-operative society. The Regional Committee directed the District Administrative Committee to cancel the order, but no heed was paid by the District Administrative Committee. Since no order was passed by the District Administrative Committee cancelling the transfer order, the Regional Committee cancelled the transfer order, by which the petitioner way transferred. Despite cancellation order passed by the Regional Committee, the District Administrative Committee has passed the impugned order insisting the petitioner to go on transfer accordance by the District Administrative Committee earlier, which way cancelled by the Regional Committee. The District Administrative Committee is well within the control of at the Regional Committee. If the order passed by the Regional Committee is violated disobeyed and if there is no power to with the Regional Committee for taking remedial measures, it matter to the Registrar Co-operative societies, who may pass the orders for taking action against the District Administrative Committee and for redressal of the grievance at the petitioner as well. It is for the Regional Committee either to take action against District Administrative at its own accord or refer the matter to the Registrar, Co-operative Socieities for the orders to be passed in the circumstances at the case.

With the above observations, the writ petition is disposed of.
