CLR No. 89 of 2002

Hon’ble Irshad Hussain, J.

Heard Sri Lok Pal Singh learned counsel for the revisionist and Sri Parikshit Saini learned counsel for the respondent nos. 1 and 2 and perused the record.

Question related to the legal heir of late Basudev Verma S/o Tejpal Singh. The name of the revisionist Smt. Sushma Devi as the heir find place in paper 14-A (Annexure -1 of the revision) and considering this it is evident that the learned trial court did not consider that the revisionist was a necessary party to the proceedings and her name could not have been deleted from array of the party.

Considering this the revision is allowed and impugned dated 24-9-2002 is set aside.
