IN THE HIGH COURT OF UTTARANCHAL AT NAINITAL Original Jurisdiction Dated: Nainital the 21st day of November, 2002

Criminal Misc. Bail Application Number 1226of 2002

Order on the Bail Application

CRIMINAL SIDE

Kishore Kumar son of Bhagat Ram, r/o Shiv Nathpur, Purani Basti, Maldhanchaur, Ramnagar, District Nainital

........................Applicant(s)

Versus

State of Uttaranchal. ..………………….Opposite Party Arising out of - Case crime no. 340 of 2001, Under Sections 147, 148, 149, 302, 323, 504, 506 of I.P.C., P.S. Ramnagar, District Nainital By the Court Hon’ble Irshad Hussain, J.

Heard the learned counsel for the applicant-accused and Sri H.C.Pande, Assistant Government Advocate on the second bail application moved on behalf of the applicant-accused.

This is a double murder case. First bail application was rejected on merit. Evidence of fact had been recorded. Since the trial is at the concluding stage, I see no cogent ground to release the applicant on bail.

Bail applicant is rejected.

(Irshad Hussain, J.)
