WPCRL No. 47 of 2012

Hon’ble Servesh Kumar Gupta, J.

Mr. S.K. Shandilya, Advocate for the petitioner.

Mr. P.S. Danu, Brief Holder for the State.

An FIR was lodged by Sub Inspector Balwant Singh on 12.01.2012 against the petitioner Rajiv Johri, who is an activist and whistleblower against corruption.

Learned counsel for the petitioner has argued that since some information was asked by the petitioner under Right to Information Act against the police, so in order to take revenge this FIR was lodged. No investigation is being done and it is pending for last one year.

Considering the facts and circumstances of the case, it is directed that petitioner shall not be arrested during the course of investigation pursuant to FIR dated 12.01.2012 case crime no. 12 of 2012 under Section 67 of the Information Technology Act, police station Kotwali Gangnahar, Roorkee, District Haridwar provided he cooperates with the Investigating Agency.

This order will come to an end, as and when, any report is filed by the police, after culmination of investigation, in the court concerned.

With the above directions, the petition stands finally disposed of.
