C482 No.1471 of 2013
Hon’ble V.K. Bist, J.
Heard
Mr. Bhupesh
Kandpal,
Advocate for the applicants.
Learned counsel for the applicants submitted that earlier an application under Section 125 Cr.P.C. was filed by the applicants in the year 2004. Same was decided on 12.06.2008. Thereafter, another application has been moved by the applicants under Section 127 Cr.P.C. for the enhancement of per month maintenance in view of the enhanced salary of the respondent. Learned counsel for the applicant submitted that more than two years have passed, but due to one reason or the other, proceedings have been prolonged in the matter and the case could not be heard. He prayed that direction may be issued to the Judge, Family Court, Dehradun to decide the Misc. Case No.342 of 2011 (arising out of Criminal Case No.228 of 2004) “Smt. Manju alias Mansi and another Vs. Deelip” at the earliest.
I have considered the submission advanced by the learned counsel for the applicant.
The application under Section 127 Cr.P.C. was filed in the year 2009 and same is still pending in the Family Court, Dehradun. In my view, such application should be decided by the Court concerned very very expeditiously.
Considering the submission advanced by the learned counsel for the applicant, I dispose of this criminal misc. application with a direction to the Judge, Family Court, Dehradun to decide the Misc. Case No.342 of 2011 (arising out of Criminal Case No.228 of 2004) “Smt. Manju alias Mansi and another Vs. Deelip” expeditiously, preferably within a period of three months from the date of production of a certified copy of this order.
