CORAM :HONOURABLE MR.JUSTICE D.H.WAGHELA

Date : 30/12/2008

ORAL JUDGMENT

Even before the petition could be entertained and notice be issued, learned counsel Mr. C.S.Popat, appeared for respondent no.2, the original complainant, with a request to quash the complaint, which is sought to be quashed in the petition. Rule. Learned counsel appearing for the respondent waives service.

In view of the fact that the complaint and the criminal case arise out of a purely private dispute among the friends and they have amicably settled the dispute and requested to allow the petition and learned A.P.P. having no objection, the petition is allowed. The complaint registered as C.R.No.I-223 of 2008 before Thorala Police Station of Rajkot is quashed by consent and rule is made absolute with no order as to costs. Vakalatnama of Mr. Popat may be accepted by the office.
