Hon’ble Irshad Hussain J. Hon’ble M.M.Ghildiyal J.

Heard Sri Sharad Sharma, learned counsel for the petitioner and learned Additional Chief Standing Counsel.

The petitioner working as a Junior Engineer in the regulated area of Roorkee has been transferred from Haridwar to Pauri. He has opted for the State of U.P. and Annexure 2 to the writ petition indicates that he has been allocated to the State of U.P. It is expected that he may be soon relived for U.P. Meanwhile, he has been transferred.

The grievance of the petitioner is that he is suffering from serious disease and is getting treatment since 13.11.1999 at Apollo Hospital. Despite the order dated 29.8.2002, he has not been relieved as is apparent from the averments made in para 16 of the writ petition.

Considering the serious illness, the petitioner shall make representation to the respondent-authorities within a period of three days from today, who shall consider the same keeping in view the difficulties of the petitioner within a period of two weeks. Till then, status quo in relation to the transfer shall be maintained.

The petition is disposed of accordingly.

(M.M.Ghildiyal J.) (Irshad Hussain, J.)
