CORAM: Z.A. HAQ J.DATED : 31[st] December, 2013.
Heard Mr. N.V.Fulzele, learned counsel for the petitioner.
The Writ Petition arises out of order passed by the learned Addl. District Judge rejecting the Application filed by the petitioner praying for an adjournment. The reason given in the adjournment Application is as follows:- “That the counsel for respondent is yet to receive briefs and instructions from the respondent and thus needs time to conduct the matter.”
The reason given by the Advocate for petitioner before the District Court, is obnoxious and cannot be accepted in law. The order passed by the learned Addl. District Judge is proper in the facts of the case.
The Writ Petition is dismissed. In the
circumstances, no orders as to costs.
Sahare
JUDGE
