Conclusion
WPCRL No.721/09
Hon’ble Dharam Veer, J.
None is present for the petitioners. Sri M.A. Khan, learned brief holder for the State, who makes a statement that after completion of investigation, charge sheet has been filed against the other accused persons, however the petitioners have not been charge sheeted as no prima facie evidence has been collected against them. Averment to this effect has also been made in paragraph no.2 of the counter affidavit filed by the I.O.
In view of the above development, the writ petition has now become infructuous. The writ petition is, therefore, dismissed as infructuous with the observation that interim order dated 17.08.2009 passed by this Court shall continue till the police report is received by the court concerned.
