CORAM: J.N. PATEL, J.(VACATION COURT)DATE: 27TH DECEMBER, 2007.

(VACATION COURT)

DATE: 27TH DECEMBER, 2007.

P.C.

. The petitioner has invoked the extra-ordinary jurisdiction of this Court seeking an ad-interim relief staying the recovery proceedings on the ground that the Divisional Joint Registrar of Co-operative Societies has closed the matter for orders on admission and stay and is yet to pass an order. Therefore, in the meantime the petitioner deserves to be protected.

2. This Court is of the view that the petitioner should move the authority concerned who has not been shown as party respondent and get appropriate ad-interim relief till the orders are pronounced rather than approach this Court because this Court is not inclined to pass any ad-interim relief as sought for.

The petition be listed before the regular bench in due course after vacation.

3. In view of the fact that this Court is not inclined to grant ad-interim relief, the learned counsel for the petitioner wants to withdraw the petition with liberty to move the Divisional Joint Registrar for seeking appropriate orders. Permitted to withdraw with liberty as sought. The petition is dismissed as withdrawn. No order as to costs.
