WPSS No. 3696 of 2017

U.C.Dhyani, J.

Mr. P. C. Maulekhi, Advocate, present for the petitioner.

Mr. M. C. Tiwari, learned Deputy Advocate General, present for the State/ respondents no. 1 & 4.

Mr. Rakesh Thapaliyal, Advocate with Mr. Pankaj Chaturvedi, present for the respondents no. 2 & 3.

By means of present writ petition, the [petitioner seeks following relief, among others:

“Issue a writ, order or direction of mandamus directing the respondents to pay entire arrear of revised pension and other benefits to the petitioner since 01.01.2006 to 15.01.2015 with interest in accordance with 6[th] Pay Commission and further direct the respondents to give the benefit of 7[th] Pay Commission to the petitioner.”

After arguing the writ petition at some length, learned counsel for the petitioner confined his prayer only to the extent that respondent no. 2 may kindly be directed to decide petitioner’s representation, to which, learned counsel for the respondents have no objection.

Present writ petition is disposed of by directing respondent no. 2 to decide the representation of the petitioner by passing a reasoned and speaking order, at an earliest possible but not later than three weeks of presentation of certified copy of this Order alongwith a fresh representation.

Needless to say that decision so taken shall be communicated to the petitioner soon thereafter.

Let a copy of this order be supplied to the learned counsel for the petitioner today itself on paymen[t of usu]al charges.

(U.C.Dhyani, J.)
