Honourable High Court for seeking pre-arrest bail.

This court is conscious of the fact that there is no legal impediment in the way of the applicant to invoke the Jurisdiction of this court under section 438 of the Cr.P.C. but it has been a sound principle and a matter of public policy that a person should move the lowest court having jurisdiction in the matter and in the present case, it would be the Court of Sessions where the offence has been registered and, therefore, this court is not inclined to entertain the application and gives liberty to the applicant to move the Court of Sessions. Application is rejected.
