Heard learned counsel for the parties.
In view of the verification endorsed by the learned Civil Judge (Sr. Div) and forwarded by the District Judge, Dehradun on compromise application No. 5731 of 2004 and this Court’s order dated 04.10.2004, the second appeal No. 27 of 2003 is decided in terms of compromise between the parties as mentioned in the affidavit accompanying the application under Order 23 Rule 3 of the Code of Civil Procedure, 1908. The same shall form part of the decree.
The second appeal stands disposed of accordingly.
