WPSS No.1115 of 2010Hon’ble V.K. Bist, J.

Shri B.S. Parihar, learned counsel

for the petitioner.

Shri N.P. Sah, learned Standing Counsel for State/ respondents. Heard learned counsel for the parties.

The claim of the petitioner for regularization has been rejected by the respondents on the ground that petitioner had not annexed any document/ order, which could show that petitioner is working from 11.11.1989. Learned counsel for the petitioner referred to the tentative list of daily wage employees in Forest Department, Uttarakhand, prior to 1991, in which the petitioner’s name has been shown at Serial No.2239. In the said tentative list, the date of joining has been shown 11.11.1989. This list was filed by the respondents themselves before the Hon’ble Supreme Court in the matter of Putti Lal’s case.

Since, the respondents themselves have admitted before the Hon’ble Supreme Court that the date of joining of the petitioner is 11.11.1989, the order dated 20.10.2010, passed by the respondent no.2 deserves to be set aside and accordingly is set aside. The respondent no.2 i.e. The Principal Conservator of Forest, Uttarakhand, Dehradun, is directed to reconsider the claim of the petitioner for regularization within a period of three months from the date of production of a certified copy of the order.

With the above direction, the writ petition is disposed of.

Interim Relief application (CLMA No.9979 of 2010) also stands disposed of.
