1. Special Criminal Application No. 884 of 2001 MS SUBHADRA G PATEL for Petitioner No. 1 MR SS PATEL, APP for Respondent No. 1 .......... for Respondents No. 2-3
-------------------------------------------------------------- CORAM : MR.JUSTICE R.P.DHOLAKIA
Date of decision: 07/12/2001
ORAL JUDGEMENT
It appears that I.G.(Prisons) has granted furlough to the present petitioner with certain conditions. Learned APP, Mr.S.S.Patel, on instructions, has stated at the bar that since the condition has not been fulfilled, petitioner has not been released from jail. Whereas learned advocate for the petitioner has submitted that in all the pending criminal cases, report under Sec.169 has been submitted. If it is so, petitioner is at liberty to move for removal of the condition before the authority and in that event, authority shall decide the same on merits.
With the above observation and direction, this Special Criminal Application stands disposed of. Rule is discharged.
