1. The petitioner is a Lecturer (Chemistry) presently posted at Government Inter College, Dhaniyakot. By means of the present writ petition, the petitioner seeks transfer from Government Inter College, Dhaniyakot to any other Government Inter College, situated near Haldwani or near Udham Singh Nagar on the ground of his as well as his wife’s ailment
2. The main ground for seeking transfer, according to the petitioner is that his wife is suffering from brain tumor and he is suffering from Bronchitis asthma. His wife is getting regular treatment from Sushila Tiwari Government Hospital, Haldwani. Learned counsel for the petitioner hence states that since 1995 he had remained posted at hill areas only. He further submits that he has made several representations for his transfer before the competent authority, but in vain as no decision has been taken by the authority as yet.
3. In view of the above situation and subject to its verification by the authorities, the writ petition stands disposed with a direction to the petitioner to make a fresh representation to respondent No. 2 – Director, Secondary Education, Dehradun who shall take a decision on the same by passing speaking order within a period of six weeks from the date of production of such representation along with certified copy of this order. The respondent No. 2 shall decide the representation in the light of the difficulties faced by the petitioner and explore avenues for the transfer of the petitioner to Haldwani or Udham Singh Nagar.
