Heard the learned counsel for the applicant and the learned Assistant Government Advocate on the second bail application moved on beal of the applicant accused. Government Advocate.
The second bail application of the co-accused Prem Singh has been granted by the Court on 14.12.2002. Having perused the record of the fist bail application as well as the copy of the statement of alleged approver Santosh, I am of the view that it is a case of parity.
Let the applicants (1) Lalit Singh Thapa son of JOga Singh Thapa, r/o village Batholi, Patti Kharkdoli, Tehsil and District Pithoragarh, (2) Sunil Singh Thapa son of Devendra Singh, r/o Batholi, Patti Kharkdoli, Tehsil and District Pithoragarh and (3) Kishan Singh son of Amar Singh, r/o village Doli, Patti Kharkdoli, Tehsil and District Pithoragarh be released on bail in on their each filing a personal bond and adequate sureties each in the like sum to the satisfaction of C.J.M., Pithoragarh.
