ORAL JUDGEMENT

1. This matter again pertains to the seniority dispute. This petition has been filed in a representative capacity. The petitioners are the promotees to the post of Agricultural Officers, Class-II whereas the respondents are direct recruitees to the said post. The dispute pertains to the inter-se seniority in between the promotees and direct recruitees.

2. In many of the cases, this Court has held that in such matters the Government has to provide alternate redressal forum for redressal of such grievances. Though the Tribunal has been constituted but its jurisdiction is very limited. Be that as it may.

3. This petition is disposed of in the terms that the Chief Secretary of the State of Gujarat shall constitute a High Power Committee under his Chairmanship with two other members, Secretary to the Government in Agricultural Department and Law Secretary. The petitioners may submit their representation in respect of their grievance to the said Committee within a period of one month from the date of receipt of certified copy of this order and that representation shall be decided by the Committee aforesaid within a period of three months and by passing a reasoned order. Till then whatever interim relief is granted by this Court in this case shall continue, and for 15 days more in case where the decision goes against the petitioners. Liberty is granted to the petitioners for revival of this special civil application in case of difficulty. The special civil application and rule stand disposed of accordingly.
