WPMS No. 2453 of 2011 Hon’ble Tarun Agarwala, J.

Mr. T.A. Khan, Advocate, present for the petitioner.

In view of the fact that the petitioner has already filed a separate suit against the landlord respondent, the question of the petitioner seeking himself to be impleaded as a co-tenant or a tenant, in his individual right, in proceedings initiated by the landlord against another tenant under Section 21(1)(a) of the Uttar Pradesh Urban Building (Regulation of Letting, Rent and Eviction) Act, 1972 does not arise. The application for impleadment was rightly rejected by the trial court.

The writ petition is, accordingly, dismissed.
