Hon. A. A. Desai, C.J.

Hon. M.M. Ghildiyal, J.

Heard Sri Manoj Tiwari, learned counsel for the petitioner and Sri B.D. Upadhayaya, learned counsel for the respondent University.

Tiwari,

Learned counsel for the petitioner does not wish to press the petition with regard to petitioner no. 2. He has pressed this petition with regard to petitioner no. 1 only.

The petitioner has applied for admission to law course in Kumaon University. It was denied. Mr. Tiwari, learned counsel appearing for the petitioner contended that the denial was on the ground that the deposit was not made in time, for which the petitioner was not responsible. We do not propose to enter into the merit of the contention.

Mr.

Learned counsel for the respondent University has particularly drawn our attention to the observations of the judgment dated 3.8.1994 delivered by the High Court of Allahabad, wherein the objectionable derogatory activities of the petitioner have been elaborated. In view of this, we are not inclined to exercise our extra ordinary jurisdiction under Article 226 of the Constitution of India.

The petition is dismissed accordingly.
