Respondents.

Sri Tapan Singh, Advocate, learned counsel for the petitioner. Sri R.C.Arya, learned Brief Holder of the State for the respondents.Date December 30, 2009.

Hon’ble B.S.Verma, J.

Heard learned counsel for the petitioner and perused the record.

The only prayer made in this writ petition is that the Consolidation Officer, 5[th] Roorkee, District Haridwar be directed to decide the objections under Section 9-A (2) of the Consolidation of Holdings Act (for short the Act) in Case No. 22 of 2009 (old No. 2899) Jan Mohammad Vs. State expeditiously.

According to the petitioner, a suit under Section 9-A(2) of the Act was earlier decided in the year 1996 vide order dated 12-9-96. The order was recalled. The objections of the respondent no.2 are pending since 2003.

Since the proceedings have become quite old, the Consolidation Officer concerned is directed to decide the Case No. 22 of 2009, Jan Mohammad Vs. State pending in that court as well as objections under Section 9-A(2) of the Act filed by the respondent no. 2, after hearing both the parties, expeditiously preferably within a period of one year from the date of production of certified copy of this order. The petitioner shall co-operate in the speedy decision of the case before the respondent no.1.

With the above direction, the writ petition is disposed of finally.
