M/s Sun Transport. ……….. Appellant

Smt. Paramjeet Kaur & others.

Versus

…………Respondents.

Mr. Mohd. Azim, Advocate for the appellant. Mr. Pankaj Purohit, Advocate for respondent No. 6.

Hon’ble B.S. Verma, J.

On 12.12.2013, no one appeared on behalf of the appellant. Accordingly, the appeal was dismissed for want of prosecution. Appellant has preferred the Restoration Application seeking recall of the order dated 12.12.2013. I have considered the averments made in the Restoration Application and, being satisfied with the reasons furnished therein, allow the same. The order dated 12.12.2013 is hereby recalled and the appeal is restored to its original number.

2. Learned counsel appearing for the appellant seeks permission to withdraw this appeal, with liberty to avail appropriate remedy before appropriate forum. Such permission is granted.

3. The appeal is, accordingly, dismissed as withdrawn with liberty as above.
