IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL

Writ Petition No. 2035 of 2013 (S/S)

Manoj Kumar and others ……….Petitioners.

Versus

State of Uttarakhand and others ......….Respondents.

Present : Mr. Rahul Consul, Advocate for the petitioners. Mr. H.M. Raturi, Additional Chief Standing Counsel for the State.

Hon’ble Alok Singh, J (Oral).

Mr. Rahul Consul, learned counsel appearing for the petitioners fairly submits that lis involved in the present petition can always be adjudicated by the State Public Service Tribunal. His only apprehension is that lis may not be decided at the earliest by the Tribunal. He further contends that the petitioners will approach the Tribunal in any case within two weeks from today, therefore, learned Tribunal may be directed to decided the claim petition of the petitioners without any unnecessary delay.

In view of the above, Mr. Rahul Consul, learned counsel appearing for the petitioners seeks permission to withdraw this petition.

Petition is permitted to be withdrawn with liberty to the petitioners to approach State Public Service Tribunal. If petitioners prefer their claim within two weeks from today, learned Tribunal shall make every effort to decide the claim at the earliest and the learned Tribunal is requested not to grant any unnecessary adjournment to either of the parties, so that parties may get final adjudication at the earliest without any undue delay.

CLMA No. 14384 of 2013 also stands disposed of accordingly.
