HIGH COURT OF UTARANCHAL AT NAINITAL

Writ Petition No. 1104 (MS) of 2001(Old No. 21038/1989)

State of U.P.

…… Petitioner

VS

Tibbitian Sayinkt Shakari Krishi Samiti Ltd.and others. …..Respondents Dated:- Hon’ble Rajesh Tandon J.

The writ petition arises out of the proceedings for Imposition of Ceiling on Land Holdings Act.

The petitioner has prayed for a writ of certiorari quashing the order dt. 1-6-1989 by which the commissioner has allowed the appeal and has recorded a finding that there is no surplus land left with the tenure holder.

In view of the aforesaid facts, I find no infirmity in the order passed by the Appellate Court.

In view of the above, writ petition is dismissed.

Dated:-25-8-2004 (RAJESH TANDON J.) M.K.
