DATED:DECEMBER 28, 2012.

Heard Mr.Abhay Sambre, learned counsel for the petitioner, Mrs.Ketki Joshi, learned Assistant Government Pleader for the respondent /State and Mr. P.B.Patil, learned counsel for respondent No.3 University.

Mrs. Joshi, learned Assistant Government Pleader submitted that the representation for extension of service of the petitioner has already been decided and the request for extension has been rejected by the Performance Review Committee. As such the petition has become infructuous.

In view of this, learned counsel for the petitioner Mr. Sambre prays for withdrawal of the petition with liberty to challenge the order of the Performance Review Committee rejecting extension.

The prayer is granted. The petition is allowed to be withdrawn and is accordingly disposed of. In my opinion liberty, as prayed, is not needed.
