SHRI AIRES RODRIGUES,AG WITH MR.P.A.KAMAT,GA- -Coram:A.M.KHANWILKAR, J.-Date:5th December, 2003

P.C.:

Heard. Affidavit-in-rejoinder filed bythe petitioner is taken on record. Inview of the affidavit filed on behalf ofthe State, sworn in by Shri Mario daSilva, Under Secretary (Law), Departmentof law, Government of Goa, dated 4thDecember, 2003, in particular theaverments made in paragraph 8 that theappointment of respondent No.1 has beendone after consultation with the HighCourt, in accordance with the Rules, there is no reason to proceed with theproposed contempt action initaited by the petitioner herein. According to thepetitioner, who appears in person, theso called process of consultationadopted by the respondent/State beforeappointing respondent No.1 is notappropriate and in conformity with the requirements of law. That issue cannotbe gone into in the present proceedings. The same is left open to be agitatedin appropriate proceedings in the eventthe petitioner takes recourse to sucha remedy, if so advised. I am notexamining the correctness of theallegations made in the affidavit inreply filed by the State and particularly against the petitioner and, disposalof this contempt petition may not beunderstood as having made any observation in that behalf. Petition is disposedof. Notice Discharged.
