C24 No. 19 of 2017Hon’ble Servesh Kumar Gupta, J.Mr. Pawan Mishra, Advocate for the applicant.

None turns up on behalf of the respondent while his counsel has been served pertaining to the present proceedings.

Previously, repeated efforts were made by this court to have the service upon the respondent by both ways but the report of the Registry dated 28.7.2017 shows that the respondent is avoiding the service.

Service upon the Advocate of the respondent is taken on the record.

The applicant is a lady residing at Dehradun while respondent is residing at Udham Singh Nagar (Rudrapur). The wife has launched some other matrimonial proceedings in the Judge, Family Court, Dehradun which are being resisted on the ground that section 9 of Hindu Marriage Act proceedings have been launched by Shri Pradeep Singh (husband).

In this eventuality, when none is turning up on behalf of the respondent, I transfer the civil suit no. 589/2016 ‘Pradeep Singh vs. Smt. Priyanka Malhotra’ under section 9 of Hindu Marriage Act pending in the court of Judge, Family Court, Udham Singh Nagar (Rudrapur) to the court of Judge, Family Court, Dehradun.

Petition finally stands disposed

of.
