Present:

Mr. M.S. Chauhan, Advocate for the petitioners.

Mr. Subhash Upadhyay, Standing Counsel for the State of Uttarakhand.

Hon’ble Alok Singh, J (Oral).

With the consent of learned counsel for the parties, petitions are being taken up for final hearing today itself. IA No. 4865 of 2013 moved in WPSS No. 1326 of 2013 stands disposed of accordingly.

Mr. M.S. Chauhan, learned counsel for the petitioners submits that petitioners were earlier appointed as Sub Deputy Inspectors, however, cadre of Sub Deputy Inspector was declared dying cadre in the year 2003 and all the Sub Deputy Inspectors were accommodated on the posts of Deputy Block Officers. Further contends that earlier the posts of Vice Principals were to be filled up through Public Service Commission. Fifty per cent posts were to be filled up by promotion from the cadre of Deputy Block Education Officer and fifty per cent by direct recruitment. Petitioners were promoted through Public Service Commission under fifty percent quota to the posts of Vice Principals in various Government Inter Colleges. Mr. M.S. Chauhan, learned counsel appearing for the petitioners further contends that vide Government Order dated 14.6.2011, State Government has decided to increase the pay-scale of Vice Principals with the further stipulation that all ninety five Vice Principals working shall be adjusted/accommodated/appointed on the post of Block Education Officers.

Mr. M.S. Chauhan, learned counsel appearing for the petitioners submits that the only grievance of the petitioners is that despite Government Order dated 14.6.2011, petitioners are not being accommodated/adjusted/appointed on the post of Block Education Officers and are being pressurized to discharge the duties of Vice Principals. Mr. M.S. Chauhan, learned counsel further contends that a representation was moved by the Union on 1.8.2011, however, no decision has been taken thereon.

Mr. Subhash Upadhyay, learned Standing Counsel appearing for the respondents fairly submits that let petitioners make their separate detail representations before respondent no. 3 with advance copy to respondent nos. 1 and 2 within three weeks from today and appropriate decisions shall be taken thereupon in accordance with law within next four weeks and decision so taken shall be communicated to the petitioners soon thereafter and copy of the decision so taken on the representation of each and every petitioner shall also be communicated to Mr. M.S. Chauhan, learned counsel for the petitioners, for information.

Mr. M.S. Chauhan, learned counsel for the petitioners fairly submits that present petition may be disposed of in the light of the statement made by Mr. Subhash Upadhyay, learned Standing Counsel for the State.

Order accordingly.

CLMA No. 10068 of 2013, 10214 of 2013, 10215 of 2013, 10217 of 2013 and 10218 of 2013 also stand disposed of accordingly.
