CORAM : DR.D.Y.CHANDRACHUD,J.

3rd May, 2005.

P.C.:

I am not satisfied with the report of the valuer dated 13th April, 2005. From the report it appears that the land is situated 3 kms. from the Pune-Banglore Highway and about 20 kms. from Kolhapur Railway Station. The land admeasures 892

sq.mtrs and the valuation which has been placed by the valuer is illusory. The report of the valuer is directed to be placed in a sealed cover.

The Official Assignee is directed to appoint some other valuer from the panel of the valuers for carrying out a fresh valuation. The fees and other ancillary expenditure are permitted to be borne from the unclaimed dividend capital account with the permission of the Court. The Official Assignee shall put up a fresh report after a fresh valuation is carried out.

Stand over to 5th July, 2005.
