Sri K.K. Shah learned counsel prays for to withdraw the appeal in view of the fact that the matter had been a amicably settled between the claimant and the owner or the vehicle and in pursuance to that compromise The compensation had already been paid by the owner of the vehicle to the claimant.
In view of this the permission to withdraw the appeal is granted and the amount deposited under the statutory provision (Rs. 25,000/-) of the act is permitted to be withdrawn by the appellant.
