IN THE HIGH COURT OF UTTARANCHAL At NAINITAL

Civil Revision No. 30 of 2003)

Nagar Palika Parishad, Haridwar, Through its executive Officer, … Revisionist.

Versus

Smt. Anita Bargoti W/o late Sri Satish Bargoti, And others. … Respondents

…………..

Hon’ble P.C.Verma, J.

Heard Sri Pankaj Miglani, learned counsel for the revisionist and Sri Lok Pal Singh, learned counsel for respondents.

This revision has been filed by the revisionist for setting-aside the order dated 24.03.2003 passed by District Judge, Haridwar in Civil Appeal No. 95 of 2001.

The application of the revisionist for impleadment has been rejected by the appellate court. Now in view of the proviso appended under Section 115 of the Code of Civil Procedure, revision is not maintainable.

Accordingly, the revision is dismissed. No order as to costs.
