------------------------------------:----------------------------------- Mr A.R.Patil, AGP for the applicant-State.

CORAM: D.B.BHOSALE,J.

DATED: 22.12.2006

P.C.:

Heard the learned counsel for the

applicant.

By this civil application, the

applicant-State has prayed for restoration of the First Appeal which stood dismissed for non-compliance of the order dated 11.8.2006. By that order, the applicant-State was directed to pay the deficit court fee within 14 days. I perused the application. For the reasons stated in the application, it is allowed in terms of prayer clauses (b) and (c). The applicant-State is directed to pay the deficit court fees within six weeks from today, failing which the appeal shall stand dismissed for nonprosecution without further reference to the Court.

The civil application is disposed of.
