Arising out of Case Crime/F.I.R. No. 199 of 2011Under Sections: 307 and 504 I.P.C.Police Station: Haldwani District: Nainital Hon’ble Prafulla C. Pant, J.

Mr. B.S.Parihar, Advocate, present for the applicant.

Mr. M.A.Khan, Brief Holder, present for the State.

Heard.

Applicant– Balwant Singh, who is in jail in connection with Crime/F.I.R. No. 199 of 2011, relating to offences punishable under section 307 and 504 of I.P.C., Police Station Haldwani, District Nainital, has sought his release on bail.

Learned counsel for the applicant pleaded that applicant is in jail for last more than six months. It is further submitted that applicant has no criminal history.

In the above circumstances, considering the period for which the applicant is in jail, and the nature of offence, without expressing any opinion as to final merits of the case, this Court is of the view that the applicant deserves bail.

The Bail Application is allowed. Let the applicant- Balwant Singh, be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Additional Chief Judicial Magistrate, Haldwani. (Urgency Application No. 4824 of 2011 stands disposed of).
