with

CLMA No. 10621 of 2010

Hon'ble Prafulla C. Pant,J.

Shri Lalit Sharma, Advocate, present for the petitioners.

Shri M.A. Khan, Brief Holder, present for the State.

Heard.

By means of this petition moved under Article 226 of constitution of India, the petitioners have sought quashing of the FIR dated 07.12.2010, lodged by respondent no.3 at Police Station Rudrapur, which is registered as crime/FIR No. 679 of 2010, relating to offences punishable under section 420, 467, 468, 471, 504, 506, 323, 406IPC.

Having considered submissions of learned counsel for the parties, and after going through the contents of the FIR, and other papers on record, this Court is not inclined to interfere with the investigation in the matter.

Therefore, without expressing any opinion as to final merits of the case, the writ petition is dismissed summarily, with the observation that if the petitioners namely petitioner no.2 Harmeet Singh, petitioner no. 3 Amarpal Singh, petitioner no. 4 Charanjeet Singh, and petitioner no.4 Kulbinder Singh surrender before the court concerned, their bail application shall be heard and disposed of without unreasonable delay. (Stay application No. 10621 of 2010, also stands dismissed).
