Hon. Rajesh Tandon, J.

By the present writ petition the petitioner has prayed a writ of certiorari quashing the order dated 22.12.04 passed by the Civil Judge (JD) Nainital.

The petitioner has also filed counter claim in the original suit and has also prayed for injunction at the same time. The grievance of the petitioner is that the injunction application is still pending and the same has not yet been disposed of. The counsel for the petitioner has confined his prayer for disposal of the injunction application only.

The Civil Judge (JD) is therefore, directed to dispose of the injunction application within a period of three months from the date of filing of the certified copy of this order. Till then the parties are directed to maintain status quo.

Subject to the aforesaid observation, the writ petition is disposed of. No order as to costs.

29.12.04 Dhyani

(Rajesh Tandon, J.)
