IN THE HIGH COURT OF UTTARANCHAL AT NAINITAL.

Writ Petition No. 1666/2003 Kapil Deo Singh

..Petitioner.

Vs.

Judgeship of Uttarakashi and another

..Respondents.

Hon’ble Irshad Hussain, J.

Heard Sri M.C. Pandey learned counsel for the petitioner and Sri Sharad Sharma learned counsel for the respondent.

2-This is a petition for quashing of the order of removal from service of a driver of Uttarkashi judgeship. The impugned order was passed by the District Judge. The learned counsel for the petitioner stated that a review petition is pending disposal with the learned District Judge. Even thereafter the petitioner has opportunity of appeal in administrative side before the High Court and considering these facts the present writ petition is premature and is accordingly dismissed.

3-However it is directed that the petitioner may have proper procedure to redress his grievance by preferring an appeal in the administrative side instead of pursuing with the review petition with the District Judge. The petitioner may also move an application before the District Judge seeking conversion of the review petition as an appeal to be remitted to the High Court in the administrative side for disposal according to law.
