The petitioner had approached this Court, inter alia, contending that they are contractors, who undertakes the pilingwork. They are presently carrying on the piling work of a projectby name “Asset Genesis” at Mattancherry. The work is beingdone for and on behalf of M/s Asset Homes Pvt.Ltd. It is statedthat demanding that the members of respondents 2 to 4 shouldbe permitted to undertake the piling work, they are creatingobstruction to the work being carried out by the petitioner.According to the petitioner, they have specialised workmen tocarry out the piling work and there is no reason as to why theyshould employ any of the persons suggested by respondents 2 to4. There is no legal obligation and as such apprehendingobstruction, a complaint had been filed before the 1[st]respondent. Since no action has been taken in the matter, thisWrit Petition is filed.

2. The 4[th] respondent has filed a counter-affidavit, interalia, contending that they are not creating any obstruction assuch. However, they are also entitled to seek employment, as faras the piling works and other works in the site of the petitioner. The learned Counsel further submits that in so far as noobjection has been created, there is no reason to grant policeprotection as sought for.

3. Though notices were served on the respondents 2 and3, there is no appearance.

4. The main contention raised by the petitioner is thatthey are having specialised workers for carrying out the pilingwork and they cannot employ any of the persons as suggested byrespondents 2 to 4. In fact, there is no legal obligation on thepart of the petitioner to engage any person suggested byrespondents 2 to 4 for the specialised work. The right of theworkmen to demand employment arise only when there is anyloading and unloading work, which, of course, has to beconsidered in a separate proceeding. As the matter stands now,we do not think that respondents 2 to 4 have any legal right todemand any work unless, otherwise agreed by the petitioner.

Under such circumstances, if there is any obstruction iscreated by respondents 2 to 4 in the matter relating to the pilingwork being carried out by the petitioner, the 1[st] respondent shallprovide adequate police protection. The Writ Petition is disposedof with the above observation.
