JUDGMENT

This Original Petition is filed aggrieved by the direction ofthe Central Administrative Tribunal in Ext.P5 to pay interest atthe rate of 10% from 11.08.2010 till the date of final settlementof the DCRG amount.

2. As a matter of fact, the petitioners herein thoughcontested the applications before the CAT, ultimately during thependency of the application, it was brought to the notice of theCAT that all retirement benefits were settled except issuerelating to the payment of interest on the retirement benefits. After referring to O.A No.958/2010 and also Rule 68 of CCSPension Rules, CAT observed that from the date of conclusion ofthe disciplinary proceedings alone, the party would be entitledfor interest on DCRG amount only. Apparently, disciplinaryproceedings ended with an order of censure and in the absence of any positive order which has legal sanctity to withhold thepayment of DCRG or in the absence of an undertaking by theemployee who is entitled to receive DCRG to withhold suchamounts towards the loan, there was no justification on the partof the department to withhold the payment of DCRG.

3. As a matter of fact, even all retirement benefits including DCRG amount came to be paid, except the interest amount, when the matter came up for hearing before the CAT. In thelight of Rule 68 of CCS Pension Rules and for the reasons statedabove, the interest at the rate of 10% is payable on DCRGamount was withheld by the employer without any reason orlegal direction.

In that view of the matter, we find no good ground tointerfere with the order of CAT. Accordingly, this petition isdismissed.
