Civil Misc. Writ Petition No. 386(M/B)/2001

(Old No.30524/1997)

Smt. Sheel Kumari Nigam and others…………… Petitioners State of U.P. and others ………………………… Respondents Hon. P.C. Verma, J.

Heard Sri Gopal Narain, learned counsel for the petitioners and learned C.S.C.

The petitioners are residents of Mussoorie township. The grievance of the petitioners is that the Municipal Corporation proposed to install garbage collection centre in the vicinity of their houses, public toilets and urinals are also proposed to be constructed. This Court in the year 1997 granted injunction restraining the Municipal Corporation for carrying those constructions.

During the pendency of this petition, the Municipal Corporation has not indicated any urgency in this regard. In view of this, at this stage cause does not survive. We, therefore, dispose of this petition. In case the Munici- pal Corporation propose to carry those impugned objectionable activities, the petitioners are at liberty to approach this Court for redressal of their grievance.
