O R D E R
In this Petition filed under Sec.439 Cr.P.C. the petitioner who isthe 1[st] accused in Crime No.299/05 of Alathur Police Station foroffences punishable under Sections 465, 471 and 420 read withsection 34 I.P.C., seeks his enlargement on bail.
2. I heard the learned counsel for the petitioner and thelearned Public Prosecutor.
3. Having regard to the nature of the offences, the durationof judicial custody of the petitioner and the other circumstances of thecase etc., I am inclined to grant bail to the petitioner with effect from30.12.2006. Accordingly, the petitioner is directed to be released onbail with effect from 30.12.2006 on his executing a bond forRs.10,000/- (Rupees ten thousand only) with two solvent sureties eachfor the like amount to the satisfaction of the J.F.C.M., Alathur andsubject to the following conditions:
1. The petitioner shall report before the InvestigatingOfficer between 9 a.m. and 11 a.m. on all Wednesdays.
2. The petitioner shall make himself available forinterrogation as and when required by the Police, till thefiling of the final report.
3. The petitioner shall not influence or intimidate theprosecution witnesses nor shall he attempt to tamper withthe evidence for the prosecution.
4. The petitioner shall not commit any offence while onbail.
If the petitioner commits breach of any of the above conditions, the bail granted to him shall be liable to be cancelled.
This application is allowed as above.
