ORAL JUDGEMENT

#. Heard the learned counsel for the respondent, perused the special criminal application and affidavit-in-reply.

#. The application filed by petitioner for his release on furlough leave came to be rejected by the competent authority. Hence this special criminal application before this court.

#. Leave has been rejected on the ground by appropriate authority that earlier he surrendered late by 903 days and after arrest by the police, when he was released on furlough leave. It has been stated that in addition to this there is another ground which prevailed with the authority to reject his application, and that is, while he was on furlough leave, he committed second murder and punishment of life imprisonment has been given by the Sessions Court, Dahod under its judgment dated 14th June 1999. In view of this fact, the authority has not committed any error in declining to grant furlough leave to the petitioner. The special criminal application is dismissed. Rule discharged.
