IN THE HIGH COURT OF UTTARANCHAL AT NAINITAL

Original Jurisdiction

Dated: Nainital: the 3rd day of December, 2002

Criminal Misc. Bail Application No. 1267 of 2002

Order on the Bail ApplicationCRIMINAL SIDE

Sukhchain Singh …………… Applicant Versus State of Uttaranchal ……………. Opposite party.

Arising Out of Crime No.802 of 2002 Under Sections: 307,323,452,336 I.P.C. Police Station: Rudrapur DISTRICT: Udham Singh Nagar.

Hon. A.A. Desai, C.J.

By the Court

Heard Mrs. Pushpa Joshi, learned counsel for the applicant and Sri D. K. Sharma, learned A.G.A.

The applicant was convicted for the offence punishable under section 307,323,452,336 I.P.C. read with section 34 I.P.C. Apparently, as revealed there is a family dispute between the applicant and the injured, who are real brothers. As per the first information report, as disclosed to me, actual fire- arm injury was caused by son of the applicant while they were returning from their agricultural fields.

Having regard to the nature of the incident and the crime, I direct that the applicant Sukhchain Singh, who is aged about 65 years be released on bail on his furnishing a personal bond with two sureties each of the like amount to the satisfaction of the C.J.M. concerned.
