1. This is defendant's revision application under section 115 of C.P.C., 1908 against the order passed below Ex.5 by the learned Civil Judge, (S.D.), Rajkot dated 31st May, 1995 in regular civil suit no. 756 of

1995.

2. This revision application came up for preliminary hearing on 23rd June, 1995, on which date, it was admitted and interim relief in terms of para- 32 (D) has been granted. Para- 32 (D) reads as under:

Pending admission, hearing and final disposal of this petition, Your Lordships be pleased to stay the execution, implementation and operation of the impugned order dated 31-5-1995 passed below Ex.6 in Regular Civil Suit NO. 756 of 1995 by the learned Civil Judge, (SD), Rajkot.

3. This order is lying under stay for all these years. Looking to the nature of the dispute and the judgment on which reliance has been placed by the counsel for the petitioner in this case of this court, the interest of justice will be met in case this civil revision application is disposed of in terms that the interim relief granted by this court shall continue till the decision of the civil suit. Learned trial court is directed to decide the civil suit within a period of nine months from the date of receipt of writ of this order. The civil revision application and Rule stand disposed of accordingly with no order as to costs.
