WPSS No.1194 of 2009 Hon’ble Tarun Agarwala, J.

Mr. Tumul K. Nailwal, Advocate for the petitioner.

Mr. N.P. Sah, Standing Counsel for the respondents.

The petitioner has challenged the suspension order dated 10/08/2009. Inspite of time being granted, no counter affidavit has been filed by the respondents.

Perused the impugned order. The petitioner has been suspended on account of interpolation in the revenue record. In the opinion of the court, interpolation of the revenue record by itself is very serious in nature. Consequently, the court is of the opinion that the suspension order is justified. This court, therefore, is not inclined to interfere in the suspension order at this stage. The writ petition is dismissed.

It has been stated that four months has been elapsed but the chargesheet has not been served so far. Consequently, the court directs the disciplinary authority to serve the chargesheet within two weeks from the date of the production of a certified copy of the order failing which the petitioner would be reinstated on the post on which he was working. In the event, the chargesheet is served, the disciplinary authority will ensure that the disciplinary proceedings comes to an end and final orders are passed within three months thereafter.

Certified copy of the order may be issued to the learned counsel for the parties on the payment of usual charges within three days.

Dated 29.12.2009 Shiv

(Tarun Agarwala, J.)
