ORAL JUDGEMENT

#. In case the matter would have been heard on merits, I have my own reservation as to whether this Court would have been in a position to maintain the order impugned in this civil revision application, however, in view of the fact that this court has protected the petitioner for all these years and looking to the nature of the suit, I am of the opinion that in case for few months more the interim relief granted by this Court is continued, it will not in any way adversely affect the respondents.

#. In the result, this civil revision application is disposed of in terms that the interim relief which has been granted by this Court on 30th December 1994 and made absolute on 2nd February 1995 shall continue till the decision of the Regular Civil Suit No.498 of 1994 in the Court of 2nd Joint Civil Judge (S.D.), Junagadh. The learned trial Court is directed to decide the aforesaid suit within a period of four months from the date of receipt of writ of this order. In case the learned trial Court is unable to decide the suit within a period of four months from the date of receipt of writ of this order, the matter has to be reported to this Court with reasons.

#. The civil revision application and Rule stands disposed of in aforesaid terms with no order as to costs.
