Petitioner is the first accused in crime no.566/2014of Cheruthuruthy police station. The offences allegedagainst him and co-accused are those punishable undersections 120B, 201, 203, 302 and 397 of the IPC r/w IPC34. The petitioner is in custody. He seeks bail undersection 439 of the Cr.P.C.

2. and the learned Public Prosecutor.

Heard the learned counsel for the petitioner

3. It is not necessary to state the prosecutioncase. The final report has already been filed. Thepetitioner was enlarged on bail on 09.07.2014. One ofthe conditions for granting bail was that he should notinvolve himself in any offence of a similar nature. But It is not necessary to state the prosecution crime no.585/2015 was registered against him andothers at the Wadakkanchery police station allegingcommission of offences punishable under sections 307and 393 of the IPC. Therefore the bail granted in crimeno.566/2014 was cancelled as per Annex-B order dated03.11.2015. The petitioner is in custody since03.11.2015. It is submitted that the petitioner has beengranted bail in crime no.585/2015. The petitioner is incustody for over one year. The trial is yet to start. Itdoes not appear that the continued custody of thepetitioner is absolutely necessary. I am inclined togrant him bail, but on condition that he should notagain involve in any offence of a similar nature. Assuggested by me on 27.12.2016, the learned PublicProsecutor has obtained a report from theSuperintendent of Jail, Viyyur. I am shown the saidreport. It is reported therein that the petitioner B.A No. 9125/2016

behaves properly in jail. I have considered that factalso for granting him bail.

In the result, the application is allowed. The petitioner shall be released on bail on his executing abond for Rs.40,000/- (forty thousand only) with twosolvent sureties for the like sum each to the satisfactionof the learned Magistrate if the case is not committedor the learned Sessions Judge who is to try the case if itis committed. The petitioner shall take notice that he isgranted bail on condition that he shall not involve inany offence of a similar nature while he is on bail. Inthe event of breach of this condition, the learnedMagistrate or, as the case may be, the learned SessionsJudge shall have the authority to cancel the bail.
