O R D E R
Petitioner, who is the 9[th] accused in Crime No: 983/2011 ofChengannoor Police Station for offence punishable under Section 511 of380 r/w Section 34 IPC, apprehending, arrest, detention and torture at thehands of the Investigation Officer has filed this petition under Section 438of the Cr.P.C, seeking an order directing the respondent to release thepetitioner on bail in the event of arrest with a plea that he was falselyimplicated.
2. Having heard either side and taking note that the petitioneris a chronic Leukemia patient, it would be appropriate to release him on bailin the event of arrest.
In the result, this petition is disposed of with direction to the petitioner to surrender before the Investigating Officer within a week. TheInvestigating Officer after interrogation and recovery, if any, shall releasethe petitioner on bail on executing a bond for Rs.20,000/- with two solventsureties each for like amount to the satisfaction of the Investigating Officersubject to the condition that the petitioner shall appear before theinvestigating Officer as and when required.
